ACCC on to Optus for misleading consumers

Optus is facing legal action from the Australian Competition and Consumer Comission (ACCC) in relation to misleading use of the word ‘limited’.

The ACCC alleges that certain television, radio and print advertisements run recently by Optus which advertise ‘unlimited’ calls on its $70 pre-paid Turbo Max plan are misleading because the offer is subject to a number of limitations and restrictions.

The allegations also relate to similar claims on Optus’ broadband and home telephone plans campaign which advertise unlimited broadband andunlimited calls, but which do have restrictions.

The ACCC argues that the above campaigns are misleading or deceptive and contravene section 52 of the Act. The proceedings have been filed in the Federal Courts Fast Track List and are listed for a Scheduling Conference at the end of June.
